1. Program Description

Program Name: Drive to Grow Communications Program

Description: Drive to Grow operates a communications program that delivers promotional, reminder, and update messages via SMS text messaging and email to customers who have opted in to receive communications. These messages are designed to keep you informed about your coaching journey and program updates.

Message Types & Frequency:

SMS Messaging: You may receive promotional, reminder, and update text messages from Drive to Grow. Message frequency varies based on your activity and engagement with our services, typically ranging from 1–4 messages per month during active coaching periods.

Email Communications: You may receive promotional, reminder, and update emails from Drive to Grow. Email frequency varies based on your activity and interest level, typically ranging from 1–2 emails per week.

You control which communication channels you receive messages through by selecting your preferences during signup. You may opt in to SMS only, email only, or both.

2. Opt-In Consent

By providing your mobile phone number and/or email address and selecting your communication preferences, you consent to receive text messages and/or emails from Drive to Grow. You confirm that:

  • You are the owner or authorized user of the mobile phone number and/or email address provided
  • You authorise Drive to Grow to send SMS messages and/or emails to these contact methods
  • You understand that message and data rates may apply to SMS messages (see Section 6)
  • You have read and agree to these Terms of Service and our Privacy Policy

Opt-in consent is documented and retained in accordance with our Privacy Policy.

3. SMS Messages – How to Cancel

Opt-Out Instructions

To stop receiving SMS messages from Drive to Grow, text STOP to (920) 789-2989.

Upon texting STOP, you will receive an automated confirmation message confirming your unsubscribe status. After confirmation, you will no longer receive SMS messages from Drive to Grow. Opt-out requests are processed within 24 hours.

If you continue to receive messages after this period, please contact us at Support@drivetogrow.com.

4. Email Messages – How to Unsubscribe

Unsubscribe Instructions

You may unsubscribe from Drive to Grow email communications at any time by clicking the unsubscribe link at the bottom of any email. You will receive confirmation of your unsubscribe request. After confirmation, you will no longer receive email messages from us.

Alternatively, you may request to be removed from our email list by contacting us at Support@drivetogrow.com.

5. How to Rejoin

Rejoining SMS Program

If you have opted out of our SMS program and wish to receive text messages again, you may:

  • Text START to (920) 789-2989, or
  • Resubscribe through your customer account at drivetogrow.com, or
  • Contact us at Support@drivetogrow.com to request reinstatement

You will need to provide your mobile phone number and confirm your opt-in consent.

Rejoining Email Program

If you have unsubscribed from our email program and wish to receive emails again, you may:

  • Click the resubscribe link in any email (if provided), or
  • Resubscribe through your customer account at drivetogrow.com, or
  • Contact us at Support@drivetogrow.com to request reinstatement

You will need to provide your email address and confirm your opt-in consent.

7. Message & Data Rates Disclaimer

MESSAGE AND DATA RATES MAY APPLY. Standard message and data rates charged by your mobile service provider may apply to SMS messages you receive from Drive to Grow, including confirmation messages and opt-out responses. Drive to Grow is not responsible for message or data charges incurred on your account. Contact your service provider for information regarding your specific messaging plan and charges.

Note: Email communications do not incur message or data rates.

8. Carrier Liability Disclaimer (SMS Only)

CARRIER LIABILITY: Drive to Grow and participating carriers are not liable for delayed, undelivered, or misdirected SMS messages. Carriers make no representation or warranty regarding the timeliness, accuracy, or completeness of any message. Drive to Grow is not responsible for carrier network failures, technical delays, or service interruptions beyond our control.

9. Consent to Receive Communications

By opting in to this communications program, you consent to receive text messages and/or emails from Drive to Grow based on your selected preferences. Drive to Grow will not contact you via other methods (such as voice calls) unless you have separately authorised such contact.

10. Privacy & Data Protection

Your mobile phone number, email address, and opt-in consent are protected under Drive to Grow’s Privacy Policy. SMS and email opt-in data will not be shared with third parties or affiliates for marketing purposes. 11. Industry Standards & Legal Compliance

Drive to Grow communications program complies with:

  • CTIA Short Code Monitoring & Compliance Program – Maintaining standards for two-way SMS messaging
  • CAN-SPAM Act – Ensuring compliance with email marketing regulations
  • US Telephone Consumer Protection Act (TCPA) – Ensuring compliance with telemarketing and SMS regulations
  • Application-to-Person (A2P) 10DLC Standards – Following best practices for business SMS messaging
  • Campaign Registry & TCR Requirements – Maintaining transparent messaging practices

This program operates under A2P 10DLC registration (SMS only) and complies with all applicable US telecommunications and email marketing regulations.

12. Age Restrictions

This communications program is intended for users aged 18 and older. If you are under 18, you may not enrol in our program without parental or guardian consent. Drive to Grow reserves the right to verify age and remove minors from our program.

13. Modification of Terms

Drive to Grow reserves the right to modify these Terms of Service at any time. Material changes will be communicated to you via SMS and/or email notification or posted on our website with an updated effective date. Your continued participation in the communications program following such changes constitutes your acceptance of the revised Terms.

14. Termination of Service

Drive to Grow reserves the right to terminate communications service to any user at any time for:

  • Misuse of the communications program
  • Violation of these Terms of Service
  • Suspected fraud or abuse
  • Legal or regulatory violations
  • Carrier directives or compliance requirements

Upon termination, you will no longer receive SMS messages or emails from Drive to Grow.

15. Limitation of Liability

DRIVE TO GROW AND ITS SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE COMMUNICATIONS PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16. Dispute Resolution

Any disputes arising from this communications program or these Terms of Service shall be governed by the laws of the State of Wisconsin, USA. You agree to resolve disputes through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable Wisconsin law.

18. Entire Agreement

These Terms of Service, together with Drive to Grow’s Privacy Policy, constitute the entire agreement between you and Drive to Grow regarding communications services and supersede all prior agreements, understandings, and communications.

ACKNOWLEDGMENT: By opting in to receive SMS messages and/or emails from Drive to Grow, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
